Terms of Service

These Terms of Service ("Terms") are an agreement between you and Momentum Labs ("we," "us"). They govern your use of the Momentum iOS app and the website at mmntum.app (together, the "Service"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who we are & scope

The Service is operated by Momentum Labs, the trade name of a sole proprietorship registered in Ontario, Canada and operated by Elias Amal. These Terms cover both the Momentum iOS app and the mmntum.app website, including features such as the AI mentor, schedules, templates, group challenges, and shared links. Our Privacy Policy explains how we handle your data and forms part of these Terms.

2. Your account

• You sign in with your Apple ID via Sign in with Apple. Keep the information associated with your account accurate.
• You are responsible for all activity that happens under your account.
• You can delete your account at any time in the app under Settings → Account → Delete Account. Deletion is permanent — your content cannot be recovered afterwards.

3. Momentum Pro subscriptions

Momentum Pro is an auto-renewing subscription purchased through your Apple ID using Apple In-App Purchase. It is available in monthly and yearly periods.

• Price. The price is shown in the app before you purchase, in your local currency.
• Renewal. Your subscription renews automatically unless you cancel it at least 24 hours before the end of the current period.
• Managing & cancelling. Manage or cancel anytime in iOS Settings → Apple ID → Subscriptions. Deleting the app does not cancel a subscription.
• Free trial. Where a free trial is offered, it converts to a paid subscription unless you cancel before the trial ends.
• Plan changes. Upgrades and downgrades between monthly and yearly plans are handled by Apple and prorated according to Apple's policies.
• Refunds. Refunds are handled by Apple under their terms — request one at reportaproblem.apple.com.
• Price changes. We may change subscription prices with advance notice. New prices apply from your next renewal; you can cancel before then if you do not agree.

4. Free tier & fair use

The free tier includes a limited AI allowance and is subject to rate limits designed to keep the Service reliable for everyone. We may adjust free-tier limits from time to time.

5. AI-generated content

Schedules, plans, and messages produced by the AI mentor are AI-generated suggestions. They may be inaccurate, incomplete, or inappropriate for your situation, and they are not medical, legal, financial, or other professional advice. You are responsible for the decisions you make based on them.

6. Your content & community features

You keep ownership of the content you create in Momentum. When you use community features — for example publishing a template or sharing a group challenge — you grant Momentum Labs a worldwide, non-exclusive license to host, store, and display that shared content so the feature can work.

• Do not publish content that is unlawful, infringing, or that you do not have the right to share.
• We may remove shared content that violates these Terms or that we reasonably believe is harmful.

7. Bring your own API key

As an optional Pro feature, you may connect your own AI provider API key. When you do:

• Your key is used to make your AI requests directly with that provider, and your usage is billed by the provider under its own terms.
• You are responsible for keeping your key valid and secure.
• We store your key encrypted and never display it back to you.

8. Acceptable use

• Do not abuse, harass, or harm other users.
• Do not scrape, crawl, or bulk-extract data from the Service.
• Do not reverse engineer, decompile, or attempt to extract the source code of the app.
• Do not use the Service for any unlawful purpose.
• Do not attempt to disrupt, overload, probe, or gain unauthorized access to the Service.

9. Intellectual property

The Momentum app, website, name, logo, and design belong to Momentum Labs and are protected by applicable intellectual-property laws. We grant you a limited, non-transferable, revocable license to use the app and site for your personal, non-commercial use. You may not copy, resell, or redistribute them.

10. Disclaimers & limitation of liability

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, Momentum Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising out of or related to your use of the Service. Our aggregate liability for all claims relating to the Service is capped at the amounts you paid us in the 12 months before the claim arose.

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service at any time and delete your account in Settings → Account → Delete Account.

12. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will notify you in the app or on the site and update the "Last updated" date above. Continued use of the Service after an update means you accept the revised Terms.

13. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules.
